Waukesha - A 50-year-old Waukesha man was charged Dec. 27 with his fifth drunken driving offense after a police officer saw the man drive on a concrete curb Christmas Eve.
Michael J. Weber was charged with felony drunken driving and misdemeanor counts of operating a motor vehicle with a revoked license and failure to install an ignition interlock device.
According to the criminal complaint, a Waukesha police officer saw a vehicle on West Avenue at 1:38 a.m. exceeding the speed limit. The officer followed the car and saw it cross the centerline and then on Rivera Drive the vehicle drove on top of the curb of the road, the complaint said.
The officer stopped the vehicle and noticed Weber appeared to be intoxicated. Weber told the officer he had four or five beers, the complaint said.
Weber failed a field sobriety test and a preliminary breath test showed he had an alcohol content of 0.18. A level of 0.08 is considered evidence of intoxication in adult drivers in Wisconsin.
People with three or more drunken driving convictions are prohibited from driving with a level of 0.02 or higher.
Weber was previously convicted in November 1997, June 1998, November 2005 and December 2010. Weber is scheduled to appear in court Jan. 5 for a preliminary hearing.
