Woman who spit at cops gets probation

24-year-old tried to kick officers after hang-up call

Waukesha - A 24-year-old Waukesha woman was sentenced by a Waukesha County Circuit Court Judge Jan. 12 to one year probation for spitting on a police officer.

Alyssa Malecki was accused of trying to kick police officers and spitting on one as they took her into custody June 11 following a 911 hang up call.

Police were called to an apartment on Kilps Court East at about 2:10 a.m. for a 911 hang up call, according to the criminal complaint.

Police went to the residence and when they asked Malecki what the problem was she did not respond. Malecki was crying and then became agitated as officers walked through her apartment. She lunged toward an officer and because of "her highly emotional state" Malecki was put in handcuffs, the complaint said.

Malecki attempted to kick an officer, made an attempt to grab one officer's groin and spat in the face of the officers, the complaint said.

Malecki was charged with felony counts of attempted battery of a peace officer, throwing or discharging bodily fluid at public safety workers and a misdemeanor charge of disorderly conduct.

In a plea agreement, those charges were reduced to misdemeanor counts of disorderly conduct and resisting an officer.
